Australian Skilled Independent visa (subclass 189)

This Australian Skilled Independent visa (subclass 189 is a permanent resident visa for points-tested skilled workers, who are not sponsored by an employer or family member or nominated by a state or territory government. This visa allows the visa holders to live and work in Australia permanently.

 

To apply for Australian Skilled Independent visa (subclass 189), the applicant will need to submit an expression of interest (EOI) and then be invited through SkillSelect.

The applicant must:

  • nominate an occupation that is on the relevant skilled occupation list
  • obtain suitable skills assessment for that occupation
  • be less than 50 years of age (not yet turned 50) at the time of invitation
  • achieved the score specified in their letter of invitation based on the factors in the points test
  • have at least competent English, and
  • meet certain health and character requirements

In the visa application, the applicant can include his/her:

  • partner (married or de facto)
  • dependent children
  • other dependent relatives.

These family members must meet certain requirements to be included as family members in the application. The application must include documentary evidence of their relationship to the applicant. The family members must also meet health and character requirements.

The applicant can add his/her partner and dependent children to the application at any time until the visa is decided.

With this Australian Skilled Independent visa (subclass 189), the applicant and any family members who have also been granted this visa can:

  • stay in Australia indefinitely
  • work and/or study in Australia
  • enrol in Medicare, Australia’s medical scheme for health-related care and expenses
  • apply for Australian citizenship (if and when you are eligible)
  • sponsor eligible relatives for permanent residence (if possible)
  • travel to and from Australia for five years from the date the visa is granted (after this time, the applicant will need a resident return visa or another visa to return to Australia; Alternatively, they can get Australian Citizenship and passport, when eligible).

How to apply for the Australian Skilled Independent visa (subclass 189)?

  • The skilled worker needs to submit an expression of interest and then be invited through SkillSelect to be able to apply for the Australian Skilled-Independent visa (subclass 189) visa.
  • To submit a complete expression of interest, the skilled worker must have competent English language skills and a positive skills assessment in the nominated occupation (or Job Ready program, if applicable).
  • If the skilled worker receives an invitation, he/she will have 60 days to apply online for the visa. During that time, the skilled worker cannot change the information in the expression of interest.
  • Invitations are based on claims made in their expression of interest, so their application must be consistent with the information that was provided in the expression of interest and it must be supported by evidence.

Who is eligible to get the Australian Skilled Independent visa (subclass 189)?

At the time the Australian Department of Immigration and Border Protection invites the skilled worker to apply for the Australian Skilled-Independent visa (subclass 189) visa, the skilled worker must have:

  • nominated an occupation that is on the relevant skilled occupation list
  • obtained a suitable skills assessment for that occupation
  • not yet turned 50 years of age
  • achieved the score specified in your letter of invitation based on the factors in the points test
  • at least competent English.

Meeting Health requirements to get the Australian Skilled-Independent visa (subclass 189)

The skilled worker must meet certain health requirements. The health examinations the skilled workers need will depend on their personal circumstances, including their country of citizenship, time spent in another country during the last five years and their intended activities in Australia. The results of the health examinations are generally valid for 12 months.

This applies to the skilled worker and any dependent family members listed in your application, whether they are migrating or not.

The skilled workers are able to organise their health examinations upfront before lodging a visa application.

Meeting Character requirements to get the Australian Skilled-Independent visa (subclass 189)

The skilled worker must meet certain character requirements. The skilled worker must be prepared to provide a police certificate from each country the skilled worker has lived in for 12 months or more during the past 10 years after the skilled worker turned 16 years of age.

This applies to the skilled worker and all the dependent family members listed in the application, whether they are migrating or not.

The skilled worker can add his/her partner and dependent children to the application at any time until the visa is decided.
